Found People Build a Resume Service Agreement

Found People Pty Ltd (we, us or our) - buildaresume@foundpeople.com.au
Person(s), companies or entities accepting the service agreement (you or customer)

1. The service includes the following:

Found People will create a formatted resume using the requested information supplied by the customer.
The customer will have the choice of a Basic Option or Premium Option, namely:

Basic Option - $150 + GST, which includes:

One formatted resume plus three correction / amendment requests.
Basic tips and tricks on how to best apply for jobs in Australia.
Basic tips and tricks regarding the best jobs boards in Australia.
Basic advice on how to prepare a LinkedIn profile.

Premium Option - $250 + GST, which includes:

One formatted resume tailormade for up to two position descriptions / job ads.
Three correction / amendment requests.
Basic tips on interview conduct weather face-to-face and/or video.
Basic tips and tricks on how to best apply for jobs in Australia.
Basic tips and tricks regarding the best jobs boards in Australia.
Basic advice on how to prepare a LinkedIn profile.

2. Payment terms, delivery and email address:

Payment is made online, once payment is received and funds cleared, the service will begin from that point and be completed in 5 business days. Any amounts paid for services rendered by us are non-refundable.
Once work is completed, the final product will be delivered electronically via email from buildaresume@foundpeople.com.au. If the customer deletes or misplaces the email, the customer may email and request the completed product at any time, however, it will only be sent to the customer email address we received at the time of payment. Please make sure the email address you use at the time of payment is the email address used for making a resend request.
If the customer has not provided the necessary and/or requested information upon payment, Found People will attempt to contact the customer via email. If within 5 business days from payment clearance, Found People cannot acquire the necessary information, or the customer is unresponsive, Found People will complete, and deliver the service with the information provided.
Depending on complexity of the work, Found People will endeavour to provide a completed product within 5 business days. In some cases, especially if the customer has not provided complete or adequate information, we may require an addition time.

3. Acceptance

By clicking Order Resume, by making a payment or by providing any information on our Build a Resume page, you confirm to have read and agreed to:

the Build a Resume Service Agreement and;
our Privacy Policy and our Website Terms of Use.

4. Our guarantees and obligations

Upon payment being received and funds cleared, Found People will:

Deliver a completed product regardless of information provided by the customer.
Provide the necessary correction / amendments relevant to each specific option.
Endeavour to deliver a completed product within a reasonable amount of time, usually 5 business / working days.

5. Your obligations and warranties

You represent, warrant, acknowledge and agree that:

The design, format, layout, tips and tricks, guidelines and any information provided by Found People is general in nature and does not guarantee any outcome, result or conclusion of any kind, and must not be used for any commercial purpose whatsoever.
You agree that Found People reserves the right to amend, change, add or remove at our discretion any information you provide, in our efforts to provide the completed product, or service.
There are no legal restrictions preventing you from engaging us, or agreeing to this agreement.
You have not relied on any representations or warranties made by us in relation to the services (including as to whether the services are or will be fit or suitable for your purposes).
You will cooperate with us, and provide us with all documentation, information and instructions necessary to enable us to provide the services.
The information you provide to us is true, correct, and complete.
You will not infringe any third-party rights in working with us and receiving the services.

6. Your statutory rights

The Australian Consumer Law (ACL) in the Competition and Consumer Act 2010 (Cth) and similar consumer protection laws and regulations, may confer you with rights, warranties, guarantees and remedies relating to the Services which cannot be excluded, restricted or modified (Statutory Rights). Nothing in this agreement excludes your Statutory Rights as a consumer under the ACL.
You agree that our liability for the services is governed solely by the ACL and this agreement.
Subject to your statutory rights, we exclude all express and implied warranties, representations and guarantees of any kind (whether under statute, law, equity or on any other basis) and all materials, work, goods and services are provided to you without warranties, representations or guarantees of any kind.

7. Liability, indemnity and exclusions

Exclusions: Despite anything to the contrary, to the maximum extent permitted by law, we will not be liable for, and you waive and release us from and against, any Liability caused or contributed to by (whether directly or indirectly): acts or omissions of you (including any works, goods or services provided by you); your breach of this agreement or any law or third party rights; any information, documentation, specifications or directions given by you; and any event or circumstance beyond our reasonable control.
Indemnity: Despite anything to the contrary, to the maximum extent permitted by law, you are liable for, and agree to make good, indemnify us and hold us harmless in respect of, any Liability that we may suffer, incur or otherwise become liable for, arising from or in connection with: acts or omissions of you; or any information, documentation, specifications or directions given by you.
Limitation of liability: Despite anything to the contrary, to the maximum extent permitted by law: we will not be liable for any consequential loss; and our maximum aggregate liability in relation to the provision of the services or this agreement will be limited to us resupplying the goods and services to you.
